Para los fines de esta pol\u00edtica de garant\u00eda, el t\u00e9rmino <\/span><b>Sistemas Electrificados<\/b><span style=\"font-weight: 400;\"> o <\/span><b>Piezas Electrificadas<\/b><span style=\"font-weight: 400;\"> se refiere a todas las unidades y piezas vendidas por <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> al cliente.<\/span><\/p><ol start=\"2\"><li><b> Garant\u00eda del Producto<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">2.1 Sujeta al <\/span><b>apartado 3<\/b><span style=\"font-weight: 400;\">, <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> garantiza que durante el per\u00edodo de garant\u00eda especificado a continuaci\u00f3n, las unidades o piezas vendidas por <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> al cliente:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>2.1.1<\/b><span style=\"font-weight: 400;\"> Estar\u00e1n libres de defectos en el dise\u00f1o, los materiales y la mano de obra; y<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>2.1.2<\/b><span style=\"font-weight: 400;\"> Estar\u00e1n libres de grav\u00e1menes o cargas.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">2.2 El per\u00edodo de garant\u00eda (\u00abPer\u00edodo de Garant\u00eda\u00bb) es el siguiente:<\/span><\/p><table><thead><tr><th><p><b>Sistemas Electrificados y Piezas Electrificadas<\/b><\/p><\/th><th><p><b>Duraci\u00f3n de la Garant\u00eda<\/b><\/p><\/th><\/tr><\/thead><tbody><tr><td><p><span style=\"font-weight: 400;\">OEM<\/span><\/p><\/td><td><p><span style=\"font-weight: 400;\">1 a\u00f1o<\/span><\/p><\/td><\/tr><tr><td><p><span style=\"font-weight: 400;\">Piezas de servicio<\/span><\/p><\/td><td><p><span style=\"font-weight: 400;\">1 a\u00f1o<\/span><\/p><\/td><\/tr><\/tbody><\/table><p><span style=\"font-weight: 400;\">2.3 Cualquier reparaci\u00f3n o reemplazo de las unidades o piezas de acuerdo con la garant\u00eda de <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> no extender\u00e1 el per\u00edodo de garant\u00eda.<\/span><\/p><p><span style=\"font-weight: 400;\">2.4 La garant\u00eda es propiedad exclusiva del propietario-usuario-consumidor original y no es transferible. Una transferencia de propiedad terminar\u00e1\/anular\u00e1 cualquier garant\u00eda restante.<\/span><\/p><p><span style=\"font-weight: 400;\">2.5 Para ciertos productos, toda la garant\u00eda ser\u00e1 nula y sin valor, a menos que el registro de la garant\u00eda se complete en l\u00ednea (<\/span><a href=\"https:\/\/warranty.bergstrominc.com\"><span style=\"font-weight: 400;\">https:\/\/warranty.bergstrominc.com<\/span><\/a><span style=\"font-weight: 400;\">) dentro de los treinta (30) d\u00edas posteriores a la fecha de instalaci\u00f3n.<\/span><\/p><ol start=\"3\"><li><b> DESCARGO DE RESPONSABILIDAD DE LA GARANT\u00cdA PARA PIEZAS CUBIERTAS Y EXCLUSIONES DE GARANT\u00cdA<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">3.1 LA GARANT\u00cdA LIMITADA EXPRESA ESTABLECIDA EN EL <\/span><b>apartado 2<\/b><span style=\"font-weight: 400;\"> REEMPLAZA TODAS LAS DEM\u00c1S GARANT\u00cdAS, YA SEAN EXPRESAS O IMPL\u00cdCITAS, ORALES O ESCRITAS, Y NO EXISTE GARANT\u00cdA IMPL\u00cdCITA DE COMERCIABILIDAD, GARANT\u00cdA IMPL\u00cdCITA DE APTITUD PARA UN PROP\u00d3SITO PARTICULAR O CUALQUIER OTRA GARANT\u00cdA PARA LAS PIEZAS EXCEPTO LAS EXPRESAMENTE ESTABLECIDAS EN ESTE ACUERDO DE GARANT\u00cdA.<\/span><\/p><p><span style=\"font-weight: 400;\">3.2 La garant\u00eda limitada expresa establecida en el <\/span><b>apartado 2<\/b><span style=\"font-weight: 400;\"> no se extender\u00e1 ni se aplicar\u00e1 a:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>3.2.1<\/b><span style=\"font-weight: 400;\"> Cualquier pieza que haya sido inadecuadamente mantenida o almacenada, que haya sido sometida a contaminaci\u00f3n, manejo incorrecto o negligente, instalaci\u00f3n, ensamblaje, alteraci\u00f3n, desarmado no autorizado, mal uso o abuso;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>3.2.2<\/b><span style=\"font-weight: 400;\"> Cualquier pieza que haya estado sujeta a falta de mantenimiento o servicio adecuado por parte del cliente final;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>3.2.3<\/b><span style=\"font-weight: 400;\"> Cualquier fallo de pieza causado, total o parcialmente, por cualquier componente de reemplazo o pieza de repuesto no dise\u00f1ado, fabricado o aprobado por <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\">;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>3.2.4<\/b><span style=\"font-weight: 400;\"> El desgaste normal de cualquier pieza o de los art\u00edculos de mantenimiento normal o piezas y componentes consumibles, incluidos, entre otros, correas, mangueras, sellos de eje del compresor, juntas, rodamientos de embrague y compresor, v\u00e1lvulas, deshidratadores, productos qu\u00edmicos, aceites, bombillas y filtros;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>3.2.5<\/b><span style=\"font-weight: 400;\"> Cualquier pieza que haya sido instalada en contra de las pr\u00e1cticas recomendadas de instalaci\u00f3n o que se haya utilizado junto con componentes no <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\">, de tal manera que, a juicio de <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\">, se vea afectado su funcionamiento;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>3.2.6<\/b><span style=\"font-weight: 400;\"> Todos los dem\u00e1s componentes del veh\u00edculo que est\u00e1n excluidos de esta garant\u00eda, incluidos, entre otros, los componentes est\u00e1ndar de calefacci\u00f3n, ventilaci\u00f3n y aire acondicionado (HVAC) del veh\u00edculo, las bater\u00edas* (por ejemplo, Trojan), los calentadores operados por combustible** (por ejemplo, Ebersp\u00e4cher), los calentadores de bloque opcionales**, los inversores o combinaciones de inversores\/cargadores opcionales***.<\/span><\/li><\/ul><p><b>Notas<\/b><span style=\"font-weight: 400;\">:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Las bater\u00edas Trojan tienen garant\u00eda del fabricante. Para informaci\u00f3n sobre la garant\u00eda, llame al 877.964.2582.<\/span><\/li><\/ul><ol start=\"4\"><li><b> LIMITACI\u00d3N DE RESPONSABILIDAD PARA PRODUCTOS CUBIERTOS<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">4.1 EN NING\u00daN CASO <\/span><b>BERGSTROM<\/b><span style=\"font-weight: 400;\"> SER\u00c1 RESPONSABLE DE DA\u00d1OS INDIRECTOS, INCIDENTALES, CONSECUENTES O ESPECIALES NI POR P\u00c9RDIDAS DE GANANCIAS RESULTANTES DE DEFECTOS O NO CONFORMIDADES EN CUALQUIER PARTE(S) O POR CUALQUIER INCUMPLIMIENTO DE ESTE ACUERDO DE GARANT\u00cdA, INCLUYENDO, PERO NO LIMIT\u00c1NDOSE A COSTOS DE REMOLQUE, ENV\u00cdO DE LA PIEZA DE REEMPLAZO, GASTOS DE ALQUILER, TIEMPO DE INACTIVIDAD O GASTOS RELACIONADOS CON EL TIEMPO DE INACTIVIDAD DE LA PIEZA O VEH\u00cdCULO EN EL QUE EST\u00c9 INCORPORADO, DA\u00d1OS A VEH\u00cdCULOS O CONTENIDOS O CARGA DEL VEH\u00cdCULO, O DA\u00d1OS DERIVADOS DE LA REMOCI\u00d3N DE LAS PIEZAS O LA INSTALACI\u00d3N DE LAS PIEZAS REPARADAS O REEMPLAZADAS, INDEPENDIENTEMENTE DE LA FORMA DE ACCI\u00d3N (CONTRATO, AGRAVIO U OTRA), E INCLUSO SI EL CLIENTE INFORM\u00d3 A <\/span><b>BERGSTROM<\/b><span style=\"font-weight: 400;\"> DE LA POSIBILIDAD DE TALES DA\u00d1OS.<\/span><\/p><ol start=\"5\"><li><b> Reembolso por Reclamaciones de Garant\u00eda<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">5.1 Sujeto a los t\u00e9rminos de la garant\u00eda establecidos en este Acuerdo de Garant\u00eda, y como \u00fanico y exclusivo remedio del cliente para cualquier incumplimiento de garant\u00eda con respecto a las partes, <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> reembolsar\u00e1 al cliente los costos de las reclamaciones de garant\u00eda en los casos en que <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> determine que es responsable de la siguiente manera:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>5.1.1<\/b><span style=\"font-weight: 400;\"> Costos de materiales al precio de venta por parte de <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> al cliente.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>5.1.2<\/b><span style=\"font-weight: 400;\"> Para piezas de servicio, el reembolso de la garant\u00eda se limitar\u00e1 al precio de compra pagado por el cliente a <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> por las piezas defectuosas o no conformes.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">5.2 Para cada reclamo de garant\u00eda y solicitud de reembolso, se debe emitir un n\u00famero de reclamo separado y un formulario de \u00abSolicitud de Garant\u00eda\u00bb para cada veh\u00edculo reparado. Las reclamaciones de garant\u00eda deben enviarse a trav\u00e9s del portal de garant\u00edas de <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> (<\/span><a href=\"https:\/\/warranty.bergstrominc.com\"><span style=\"font-weight: 400;\">https:\/\/warranty.bergstrominc.com<\/span><\/a><span style=\"font-weight: 400;\">), y el cliente deber\u00e1 devolver autom\u00e1ticamente las piezas defectuosas a <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> dentro de los 30 d\u00edas posteriores a la reparaci\u00f3n. El costo de env\u00edo ser\u00e1 prepagado por el cliente y se reembolsar\u00e1 solo si la reclamaci\u00f3n es aprobada por <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">5.3 <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> acuerda responder a todas las reclamaciones de garant\u00eda dentro de los 30 d\u00edas de la fecha en que (a) se presente la reclamaci\u00f3n o (b) se devuelvan las piezas defectuosas a <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\">, lo que ocurra m\u00e1s tarde.<\/span><\/p><p><span style=\"font-weight: 400;\">5.4 El reembolso de <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> por las reclamaciones de garant\u00eda deber\u00e1 realizarse dentro de los 30 d\u00edas siguientes a la determinaci\u00f3n final de responsabilidad.<\/span><\/p><p><span style=\"font-weight: 400;\">5.5 El remedio de garant\u00eda y reembolso aqu\u00ed establecido est\u00e1 expresamente condicionado a:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>(a)<\/b><span style=\"font-weight: 400;\"> El pago completo del precio de compra de las piezas.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>(b)<\/b><span style=\"font-weight: 400;\"> Que el cliente proporcione a <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> un aviso por escrito del defecto o no conformidad dentro de los 60 d\u00edas desde el momento en que el cliente descubri\u00f3 o deber\u00eda haber descubierto el defecto o la no conformidad.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>(c)<\/b><span style=\"font-weight: 400;\"> El almacenamiento, la instalaci\u00f3n, el ensamblaje, la operaci\u00f3n, el uso y el mantenimiento de las piezas conforme a las instrucciones escritas de <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\">.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>(d)<\/b><span style=\"font-weight: 400;\"> La presencia del n\u00famero de serie original o la etiqueta de fecha de garant\u00eda en las piezas, sin alteraciones y en su condici\u00f3n original.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>(e)<\/b><span style=\"font-weight: 400;\"> La devoluci\u00f3n de las piezas a <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\">.<\/span><\/li><\/ul><ol start=\"6\"><li><b> T\u00e9rmino y Aplicabilidad de la Pol\u00edtica de Garant\u00eda<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">6.1 Las disposiciones relacionadas con las garant\u00edas, los remedios y la responsabilidad con respecto a las piezas vendidas por <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> al cliente bajo esta pol\u00edtica de garant\u00eda no pueden ser modificadas, modificadas o suplementadas de ninguna manera, excepto a trav\u00e9s de un acuerdo por escrito, firmado por ambas partes, que reconozca que modifica esta Pol\u00edtica de Garant\u00eda.<\/span><\/p><p><span style=\"font-weight: 400;\">6.2 Las partes acuerdan adem\u00e1s que esta Pol\u00edtica de Garant\u00eda establece el acuerdo completo y la comprensi\u00f3n de las partes con respecto al tema de la garant\u00eda de las piezas vendidas por <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> al cliente. No existen promesas, t\u00e9rminos, condiciones u obligaciones, orales o escritas, expresas o impl\u00edcitas con respecto a este tema, m\u00e1s all\u00e1 de los contenidos en esta Pol\u00edtica de Garant\u00eda, y ninguna de las partes podr\u00e1 basarse en ning\u00fan acuerdo, entendimiento o disposici\u00f3n con respecto a las garant\u00edas de las piezas vendidas por <\/span><b>Bergstrom<\/b><span style=\"font-weight: 400;\"> al cliente que no est\u00e9 expresamente identificado aqu\u00ed.<\/span><\/p><ol start=\"7\"><li><b> Ley Aplicable<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">7.1 Este Acuerdo de Garant\u00eda se regir\u00e1 e interpretar\u00e1 de acuerdo con las leyes del Estado de Illinois.
